You acknowledge and agree that you will not conduct any Trading Tests searches or use any content or information obtained through the Site about any individual (“Search Subject”) for any purpose. We take such violations seriously and reserve the right to terminate user access, close accounts, and report violators to the appropriate authorities.

Trading Tests does not collect or provide information for the purpose of furnishing consumer reports. By using the Site, you understand and agree not to use any information obtained from Trading Tests for any purpose.

While we will make reasonable efforts to suppress or de-index eligible records from appearing on our platform, we cannot guarantee that your information will be removed from all external sources or that it will not reappear if re-provided by those sources in the future.

If your data is being republished from a third party that maintains its own opt-out policy, we may direct you to that provider’s removal process.

16. No Support by Trading Tests

You understand that your use of the Website is at your own risk and that Trading Tests does not commit to provide any assistance other than the information posted on the Trading Tests Website. Trading Tests is under no obligation to provide you with any error corrections, updates, upgrades, bug fixes and/or enhancements of the Website.

17. Indemnification

You agree to defend, indemnify, and hold harmless Trading Tests, its vendors, and their respective directors, officers, employees, and agents from and against all claims and expenses, including legal fees, arising out of your use of the Website. Trading Tests reserves the right, at its own expense and in its sole discretion, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you. In that event, and only in such event, shall you have no further obligation to provide indemnification for Trading Tests in that matter.

Trading Tests has the right to terminate your access to the Website for any reason, including, without limitation, if it, at its sole discretion, considers your use to be unacceptable, or in the event of any breach by you of the Website Terms of Service (either directly or through breach of any other terms and conditions or operating rules applicable to you). Trading Tests may, but shall be under no obligation to, provide you a warning prior to termination of your use of the Website.

19. Billing, Cancellations & Refunds

Trading Tests can at any time offer various plans, including promotional and standard options.

Fee structures are advised onsite and can be subject to change. These are;

For those seeking an earlier test date an amount per Test Centre search and on acceptance of an agreed swap the standard test fee amount as determined at that time by the DVSA. This must be paid on completion of accepting the swap and prior to swap details being released.

For those offering a swap only the Test Centre search fee applies, the replacement test fee is not charged.

Your contract is determined by what you select during your request entry data submissions. On completion within the Website, you advise the number of Test Centres which you wish to appear for in swap searches. The applicable subscription fees are shown at the checkout page and will be charged to the payment method you enter.

You can cancel or change your search criteria at any time either:

• By logging into your account dashboard and following the steps, or
• By contacting our Support Team at support@tradingtests.co.uk

Your initial payment is final, alterations to search dates are available at no charge, however, there is not an option to cancel the service and request a refund or ask your payment provider to dispute the payment. Dispute resolution, Trading Tests reserve the right to charge to your given payment method any charges incurred by Trading Tests should these arise from a breach of these terms.

Billing Errors, Promotional Pricing & Discounts

Any applicable promotional discounts or special pricing will be clearly shown on the checkout page at the time of purchase. If you believe you were billed incorrectly, please contact our customer service team at support@tradingtests.co.uk as soon as possible. We will work to resolve billing issues promptly.

Cancellation Policy

You may cancel your search request through your dashboard but please note the most effective way to do this is to advise us by email to support@tradingtests.co.uk stating your name, original test date and test number. We will confirm your request by reply.

Refund Policy

If you believe you have entered your information incorrectly you may request a refund and cancellation by contacting support@tradingtests.co.uk. Refund requests are reviewed on a case-by-case basis, with customer satisfaction as our primary goal.

Please note:

• Repetitive or bad-faith refund requests may be contested.
• To process a refund, you must provide accurate and complete information (name, billing address, etc.). Incomplete or incorrect details may cause delays.
• Depending on your bank, refunds may take up to 30 days to appear on your statement.

If you have questions about whether a refund has been processed, feel free to contact our support team.

20. Discounts & Promotions

Any applicable discounts or promotional prices will be applied at the time of purchase on the checkout page for your order pursuant to the specified terms and/or billing details.

21. Reversals & Chargebacks

Chargebacks and reversals may be treated as potential cases of fraud and/or theft of our services. We reserve the right to file a complaint with the appropriate local and federal authorities to investigate or take other action we deem appropriate in our discretion.

22. General Payment Information

The Company offers several methods of payment for you to purchase including debit cards, credit cards and more. You must provide us with current, complete and accurate information for your chosen payment method. In the event that the requested evidence or proof is not provided or is insufficient, we reserve the right to refuse to accept the order. If you believe your credit or debit card might have been used in a fraudulent manner to purchase a Membership Plan or other product offering, please contact our customer service department at support@tradingtests.co.uk.

By ordering a product offering through the Website, you authorize the Company to charge your provided payment method pursuant to the terms of the offer you accepted. It is your responsibility to ensure that sufficient funds are available to cover the charges for the purchase, and we have no liability for any overdraft or other fees that you may incur as a result of our processing of your payment. Should an authorized payment be declined, you authorize the Company to make additional attempts to collect from the payment account provided.

While we strive to maintain the security of our systems, we do not guarantee that unauthorized access, disclosure, alteration, or destruction of data will never occur. In the event of a security breach involving your personal data, we will notify you in accordance with applicable laws. You acknowledge and agree that notification may be delayed addressing legitimate needs of law enforcement or measures necessary to determine the scope of the breach and restore system integrity.

Trading Tests relies on third-party data providers for much of the information shown and does not control how or when those providers notify or disclose data-related security incidents.

25. Export Control

You agree to comply with all export and import laws and restrictions and regulations of the United States or any foreign agency or authority, and not to export, re-export or import the Website or any direct product thereof in violation of any such restrictions, laws, or regulations, or without all necessary approvals. For example, you may not export or re-export any commodities, software, or technical data received from Trading Tests, or any direct product of such commodities, software, or technical data, to any proscribed country, party, or entity listed in the applicable laws, regulations, and rules of the U.S. Government unless properly authorized. As applicable, each party shall obtain and bear all expenses and responsibility relating to any necessary licences and/or exemptions with respect to its own export or re-export of the Software from the U.S.

26. Change of Control / Successor in Interest

In the event of a merger, acquisition, or other sale of all or a portion of our assets, your personal information may be transferred to the successor or acquiring entity. You acknowledge and agree that such transfers may occur and are permitted under these Terms. Any successor will be bound by the terms of these Terms and our Privacy Policy as it applies to your data.

When you sign up for any Trading Tests services, you consent to receive electronically from Trading Tests any privacy or other notices, agreements, disclosures, reports, documents, communications, or other records (collectively, 'Notices'). You agree that Trading Tests generally can send you electronic Notices in either or both of the following ways: (1) to the e-mail address that you provided to Trading Tests during registration or (2) on a welcome screen or top page of the relevant product or service. The delivery of any Notice from Trading Tests is effective when sent by Trading Tests, regardless of whether you read the Notice when you receive it or whether you actually receive the delivery. Your only method of withdrawing consent to receive Notices electronically is to terminate any subscriptions, services or other products provided under these Terms of Service.

Some functionality of the Website and applications utilizes information provided by third parties.

29. Dispute Resolution

You agree that any judicial proceeding to resolve claims or disputes relating to these Terms of Use will be brought in the state or federal courts located in Delaware USA, subject to the mandatory arbitration provisions below. You consent to personal jurisdiction, and the venue is such courts. If you reside in a country with laws that give consumers the right to bring disputes in their local courts, then these provisions do not override those laws.

The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

The Parties agree that the following Disputes are not subject to the above provisions concerning binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

Entire Agreement

There are no understandings, agreements, conditions, or representations, oral or written, express or implied, with reference to the subject matter hereof that are not merged herein, expressly referenced herein, or superseded hereby.

The failure or delay of Trading Tests to exercise or enforce any rights or provision of the Website Terms of Service does not constitute a waiver of such right or provision.

Survival

All provisions which must survive in order to give effect to their meaning, shall survive any expiration or termination of these Website Terms of Service, including without limitation all of your representations, warranties, and indemnification obligations.

Provisions Unenforceable or Invalid
